Southampton Town Board Extends Moratorium on Battery Energy Storage Systems

Southampton Town Board has unanimously agreed to extend the moratorium on Battery Energy Storage Systems (BESS) for an additional six months. The decision comes after concerns were raised by Hampton Bays residents regarding the proposed Canal BESS project near the Shinnecock Canal. In response to these concerns and the recommendations of the New York State BESS task force, the board has hired consultants from VHB, Inc. to help develop new code for the siting and safety of BESS facilities.

Initially, Southampton Town had approved code for BESS based on the model code suggested by the New York State Energy Research & Development Agency (NYSERDA) during the pandemic. However, following three fires at BESS facilities in New York State and the large scale of the Canal BESS project, public attention and concerns regarding the safety of these facilities have grown.

Janice Scherer, the Southampton Town Planning & Development Administrator, acknowledged the need for upper limits and fire safety protocols, which were absent in the original code. The town is now working with community stakeholders to come up with a set of recommendations to address these concerns. Town Supervisor Maria Moore stated that the town is committed to responding to the state’s recommendations and limiting the size of future BESS facilities while addressing safety issues.

The state battery working group has invited public comments on its 15 code recommendations, which will be accepted until March 5. Although some members of the public are supportive of the moratorium extension, there are those who believe it should be longer or that BESS should not be allowed in the town at all.

While progress in drafting the new code within the six-month timeframe is challenging, the Southampton Town Planning Commission has agreed to meet with the Suffolk County Planning Commission to update them on the town’s progress. Concerned residents emphasized the need for careful consideration and evaluation of the Canal BESS project and expressed their belief that the original zoning and the issuance of a negative declaration were done hastily.

The attorney for Canal BESS expressed discontent with including the project in the moratorium and argued that it should have already been approved. However, the board maintains that the moratorium is necessary to ensure proper evaluation and consideration of the project’s impact. Ultimately, the goal is to prevent large-scale BESS facilities from being located near residential areas and to prioritize safety.
